INTERMEDIATE EXAMINATION: SEPTEMBER 2026

(ii) Main constitutional pillars of GST
Concurrent powers are given to Parliament and State Legislatures to
make laws governing taxes on goods and services.
IGST (Integrated Goods and Services Tax) on inter-State transactions
of goods and services is to be levied and collected by the Central
Government and apportioned between the Union and the States in
the manner provided by Parliament by Law as per the
recommendation of the GST Council.
Parliament is empowered to formulate the principles for
determining the place of supply and when a supply takes place in
the course of inter-State trade or commerce.
Goods and Services Tax means any tax on supply of goods, or
services or both except taxes on the supply of the alcoholic liquor
for human consumption. Thus, GST can be levied on supply of all
goods and services except alcoholic liquor for human consumption.
President is empowered to constitute a joint forum of the Centre
and States namely, Goods and Services Tax Council (GST Council).
GST Council shall make recommendations to the Union and the
States on:
(a) taxes to be subsumed in GST,
(b) goods to be taxed and to be exempted,
(c) model GST laws,
(d) GST rates,
(e) registration threshold limits and
(f) special provisions for Special Category States.
