Answer. No, the rights and Directive Principles of State Policy both are equally important for the
poor population of the society. The right of speech and expression are equally important as the
creation of good working conditions and minimum wage for the lower class. The negative claims
like rights are also important for the poor people, as they can use the respective claims to
question the governmental policies and make them accountable.

Q7 Several reports show that caste groups previously associated with scavenging are forced to
continue in this job. Those in positions of authority refuse to give them any other job. Their

Answer. Many rights are being violated in the above instance and those are:

(a) Right against exploitation.
(b) Right to equality.
(c) Cultural and Educational Rights.

The “Right against exploitation” is being violated as the basic rights of the lower caste is
being violated and they are being discriminated against , in the name of religion and
baseless beliefs. The rights of minorities to represent and work for the maximum and
integrated development of the society is also being violated. “Right to Equality” is
violated on the terms of the discriminatory patterns of the society and caste-groups in the
employment and educational sectors.

Q9 Read the statement by Somnath Lahiri in the Constituent Assembly quoted in this chapter.
Do you agree with him? If yes, give instances to prove it. If not, give arguments against his
position.

Answer. “I feel that many of these fundamental rights have been framed from the point of view
of a police constable… you will find that very minimum rights have been conceded and are
almost invariably followed by a proviso. Almost every article is followed by a proviso which takes
away the right almost completely,... …What should be our conception of fundamental
rights?...We want to incorporate every one of those rights which our people want to get.”

Somnath Lahiri

CAD, Vol. III, p. 404, 29 April 1947

Yes, I agree with Somnath Lahiri’s statement as he discloses the capitalistic and very narrow
character of the respective rights. The need for the socialistic rights like equal pay for equal
work, marital rape, feministic rights, economic rights etc is highlighted and surfaced its lacking
scalability among the masses.

Q10 Which of the Fundamental Rights is in your opinion the most important right? Summarise
its provisions and give arguments to show why it is most important.

Answer. “Right to life” is to be considered as the most imperative right, despite being quite
negative in its character. The emphasis upon the basis socio-political needs of the masses
enables us to have a diverse viewpoint regarding the fundamental rights. For the enjoyment of
all the respective rights, the foundation is laid down by the “right to life” as it is formed on the
principles like individuality and social responsibility.
